These Terms and Conditions of Use (hereinafter the “Conditions”) govern access and use of the Moviby platform (hereinafter “the Platform”). By accessing the site or using the services offered by Moviby, you fully and unreservedly accept these Conditions.

1. Presentation of the platform

Moviby is a streaming platform acting exclusively as an aggregator and disseminator of links to audiovisual content (films, series, videos) from independent third-party platforms.

⚠️ Important statement:

  • Moviby does not store, host or distribute any video files on its servers.
  • Moviby does not have any ownership rights on the content accessible via the Platform.
  • All content is hosted and distributed by third-party services which assume full responsibility.
2. Acceptance of the Conditions

Use of Moviby implies full acceptance of these Conditions. If you do not accept all or part of these Terms, you must immediately stop using the Platform.

3. Access to the service

Access to Moviby can be free or paid depending on the offers offered (weekly, fortnightly or monthly subscriptions).

  • Access is strictly personal and non-transferable.
  • Any attempt at sharing, resale or fraudulent use will result in immediate suspension of access, without refund.
4. Subscriptions and payments

Payments are made via secure third-party payment providers, including MonCash.

Moviby does not store any sensitive information related to payment methods (numbers, codes or bank data).

⚠️ Payment policy:

  • Once the subscription is activated, no refund can be required, unless otherwise required by law.
  • In the event of a malfunction of the payment service, the user must contact the service provider concerned directly.
5. Third party content and copyright
5.1 Origin of content

The content accessible via Moviby comes exclusively from third-party platforms. Moviby acts only as a technical intermediary facilitating access to this content.

5.2 Intellectual property

The copyright and intellectual property rights relating to the contents belong exclusively to their respective rights holders.

Moviby has no control over:

  • the legality of content hosted by third parties;
  • their availability or accuracy;
  • any geographical restrictions.
5.3 Limitation of liability

Moviby cannot be held responsible:

  • content distributed by third-party platforms;
  • the deletion or unavailability of content;
  • any direct or indirect damage resulting from the use of third-party content.
6. Authorized use

The user undertakes to:

  • use Moviby only for personal and legal purposes;
  • do not download, copy, redistribute or commercially exploit the accessible content;
  • do not circumvent protection, access limitation or security systems.

Any violation may result in immediate termination of access, without notice or compensation.

7. Service Availability

Moviby is provided “as is” and “subject to availability”. We do not guarantee continuous, uninterrupted or error-free access.

Technical maintenance or causes beyond our control may result in temporary unavailability.

8. Termination and suspension

Moviby reserves the right to suspend or terminate a user's access, without notice, in the event of:

  • violation of these Conditions;
  • fraudulent or abusive activity;
  • legal obligation or judicial decision.
9. External links

The Platform contains links to third-party sites over which Moviby exercises no control.

Access to these sites is under the sole responsibility of the user. Moviby disclaims any responsibility for the content, practices or policies of these third party sites.

10. Data protection

The collection and processing of personal data is governed by the Moviby Privacy Policy, available on the Platform.

11. Modification of the Conditions

Moviby reserves the right to modify these Terms at any time. The modifications will take effect as soon as they are published on the Platform.

It is up to the user to consult this page regularly.

12. Applicable law and jurisdiction

These Conditions are governed by the law in force in Haiti.

Any dispute relating to the use of Moviby will fall under the exclusive jurisdiction of the Haitian courts, unless otherwise mandatory by law.
